I have had a problem with this company since 1997. It started with Wells Fargo, who sold our mortgage to GMAC. We have been making bi-weekly payments in excess of our mortgage payment for two years. For 2 years they have taken the excess and applied to late fees, held checks for a month and called them late, then sent default notices and charged inspection fees. Additionally, they have never accounted for excess payment on any of our activity reports.

Currently we are fighting over a discrepency in their posting. As they have the habit of holding your payments (which they deny) they then apply them all to one date and show current dates as past due. This has been a 2 year battle and currently they are listing us as in default, while our mortgage balance is within $100 of what our contract said it should be.

(this is without taking in to account that we have paid over 2 full extra payments)

Additionally I can never get the same "service representative" twice. Most recently I received a phone call from a Shari Hall who followed up with a letter and only addressed one of the five missing payments. I then tried to reach her by phone and first got a disconnected # and reference to another #. After calling that number I was told that Shari did not work at that office.

Once they found her, she was not the vice president of mortgage loans as it said on her letter, but a customer service manager.

I AM LOOKING FOR ENOUGH ANGRY PEOPLE TO FORM A CLASS ACTION SUIT and sue for damages, loss of time, emotional duress, illegal practices and unwarranted late fees.
