Their atttorney is Megan Miller (FAX=520-323-6614). Northern Trust is harder to reach but the managing director of their Arizona office is John L. Claps (PHONE=520-615-2300). | | Thursday, April 20, 2000 - 04:29 pm When I called Mr. Claps at Northern Trust he was not available. I spoke with a secretary/receptionist, and she was too busy to take a message. Apparently their phones were ringing off the hook. She had NO fax number or E-mail to give out. How odd. So I left a VM for Mr. Claps to comment on the website or E-mail me. Any legitimate business would have a fax number, sounds like they're just about out of business already.

| | Thursday, April 20, 2000 - 07:00 pm I am disgusted by the actions of Tucson Realty and Northern Trust bank in this case. I applaud the efforts of the Hixons to warn other consumers. It is companies such as these that give big business a bad name. This is truly shameful.

You didn't just crawl outta the woods, creating your misery due to your own incompetence. You are obviously very intelligent and diligent, it's unbelievable what you had to go through. I still cannot at all understand how your $20K NONREFUNDABLE deposit could be retained by Northern Trust when they did NOT accept your offer. Aside from the countless illegal business practices described on your pages, HOW can they keep your deposit while selling to someone else???????? Have you filed any complaints with their licensing agencies?

As to court depositions and filings, I would be happy to provide them to you. While my webpage reflects my account of the proceedings, I took most of what was on my web site from filings done on my behalf by my attorney, Nr. Monroe. I believe that Ms. Miller can corroborate the basic facts of the case (despite the fact that she is representing the other side). Namely, that I had a valid contract to purchase the house, that I was represented by a Tucson Realty and Trust agent, that the competing bidders were also represented by the same agency, that I was not informed of this dual agency, that the other party was represented by the other agents husband, and that the other party is presently living in the house. These are facts. Again, I would be willing to send you copies of contracts and court filings. Please let me know if these would be of interest to you. With best regards, Eugenie

| | Friday, April 28, 2000 - 09:09 pm Hi everyone, After three years of this battle, the depositions and court documents exceed several thousand pages. This might make scanning all of the files difficult, but I could scan some initial ones as a ZIP file, and then send you more as requested. I have filled an entire filing drawer just with all of the motions, court dates, depositions etc. connected with this case. The basic facts are simple so I can send you documents which summarize this. From my point of view, the attorneys keep avoiding any resolution by simply clogging the courts. | | Friday, April 28, 2000 - 09:13 pm How small is small? I've been wondering how many documents there are. Am also curious why it's taking so long for the Hixons to get their day in Court. A chronology of events, along with scans of significant documents? I just got the HP OfficeJet 720 with a scanner and OCR, but I haven't used the scanner yet. Text files would be much smaller, but I'd hate to have to proof read and correct a large number of pages. For most documents a summary would be fine, but I'd like to see the depositions in their entirety. Let's see what Eugenie has to say about publication on the web and about how many pages we have. I'm personally interested in the case, and it would be something a little different.
