Dear Ms. Baker:
Please retract your libelous statements about me in the same manner
in
which you have published them.
from our conversation last week it was quite evident to me that you
had absolutely no idea of what a preliminary injunction is, and what
is
required under California law for one to issue. In order for a judge
to issue
a preliminary injunction, in this case keeping Cindi in possession
of the
house pending the final trial on the merits of the case, the plaintiff
must
show a likely that she will ultimately prevail in the action.There
was
nothing
improper about Judge Wade doing his own accounting of Cindi's payments
and how they were applied. In fact, it was quite commendable of him
to do
so.
It was also quite apparent to me and to all present that Judge Wade
did not
want to remove or keep Cindi out of the house.However, he believed
that
it would have been unlawful for him to have granted the preliminary
injunction, because he believed that Cindi would ultimately prevail
in her lawsuit.
I will be looking for your immediate retraction in this matter, as same
will
most likely immunize you from a libel lawsuit by me against you, and
anyone else responsible for falsehoods published by you in this webpage.
